In August of 2016, a 46-year-old male, was rear ended while waiting at a stop light. The accident caused the man severe pain in his neck and back, necessitating treatment through massage therapy, physical therapy, and chiropractic treatments. This treatment resulted in over $13,000 of medical expenses. Prior to litigation, the liability insurance carrier for the at-fault driver claimed this was a low-impact accident without any serious injuries. As a result, they were not willing to offer anymore than $5,500 to settle his claim. The case was filed in Spokane County in early 2019. After extensive discovery, including the disclosure of testimony from lay and expert witnesses, in June of 2020 the claim went to arbitration. Pat Fannin, on behalf of the plaintiff, was able to successfully argue to have vast quantities of character evidence excluded. In addition, the plaintiff received an award of over $22,398.56 for past medical expenses and pain and suffering.
